The Liberal Party of Premier Alexander C. Rutherford was re-elected with 36 of the 41 seats in the legislature, and just under 60% of the popular vote. The Conservative Party led by Albert Robertson formed the official opposition, with only two members. The remaining three seats were split between smaller parties and independents. Robertson was defeated in his own seat in High River.

Prior to the election, the Legislative Assembly passed An Act respecting the Legislative Assembly of Alberta which was assented to on 25 February 1909. The Act created an additional 26 seats in the Legislature, lifting the total to 41, and redistributed the boundaries of the provincial electoral districts.[1]

The vote in the district of Athabasca was conducted on 15 July 1909 due to the remoteness of the riding.
